UK lawyers’ open letter concerning Gaza

JVL Introduction

We repost below the list of signatories to an open letter, signed by a substantial number of UK legal practitioners, legal academics and former members of the judiciary, calling on the UK Government to act urgently to fulfil its international legal obligations in relation to the ever-escalating conflict in the Middle East.

The full letter

  • describes in some detail the situation in Gaza which it calls “catastrophic”;
  • analyses the serious violations of intenational law that occured on 7th Ocober but makes it absolutely clear that “The commission by one party to a conflict – including an armed group – of serious violations of international humanitarian law does not, however, justify their commission by another party.”
  • makes urgent requests on the UK cgovernment which it says is duty-bound to “respect and ensure respect” for international humanitarian law as set out in the Four Geneva Conventions

Dear Prime Minister, Foreign Secretary, Defence Secretary,

We the undersigned legal practitioners, legal academics and former members of the judiciary, in the United Kingdom (UK), dedicated to upholding the rule of law both domestically and internationally, call on the UK Government to act urgently to fulfil its international legal obligations in relation to the ever-escalating conflict in the Middle East.

In doing so, we are deeply mindful that many people in the UK – including Israelis and Palestinians, and those in the broader Jewish, Arab and Muslim communities – have close ties to the region, and we express our sympathy to all of them, particularly the bereaved, and those whose loved ones are still in grave danger. We are moved to intervene because, in a region already accustomed to great suffering, the death and other harm visited on individuals, families and whole communities in the last 20 days has been truly terrible.

    Does anyone know please whether this splendid letter has been circulated beyond the UK, to sympathetic lawyers and legal / judicial associations in the USA, EU, Israel and Arab / Muslim world? Sight of the UK letter might prompt lawyers in other countries to consider how they might adapt the text to communicate with local audiences and opinion leaders.

    I realise I could put the same question directly to the originators of the UK letter but feel someone in JVL probably already knows the answer … and would be more likely to pass on what they know.

    Thank you. Israel’s response has been totally disproportionate and like Hamas they are now guilty, in my eyes, of crimes against humanity.

    The reluctance of the UK government to recognise and condemn Israel’s behaviour is deeply distressing to me and should not be allowed to go unchallenged.

    Two wrongs do not make a right.

    We hear NOW the ICC is actively investigating – as best it can – war crimes and crimes against humanity that have taken place in Israel and Palestine. It’s possible the letter from so many of the UK’s leading lawyers may have heartened the ICC taking this action. I hope so. So many different candles are now flickering in the (heart and stomach sickening) darkness they must surely have some effect.

    Can I ask again – does anyone know whether this letter has been copied to the leading lawyers of the USA, Canada, EU, Palestine, Israel, etc?
